Supports a lower fee for securing property rights in the land register
On March 10, the Legal Commission of the Saeima supported the proposal for the reduction of the “disproportionately high” state fee for the registration of specific cases of expropriation of real estate in the land register. The proposal of deputy Gats Egliš (JKP) provides that the Cabinet of Ministers should amend the regulations on the state fee in connection with the consolidation of property rights in the land register. As the deputy explains, the proposal is intended to reduce the amount of the state fee for a natural person from the currently determined 2% to 1.5% of the property value, while for a legal person for the consolidation of the property of an apartment, it should be reduced from 6% to 2% of the property value. More specifically, the proposal envisages establishing that a state fee of 1.5% of the real estate value for confirmation in the land register should be determined for land property or land and building property, or building property, which includes a residential house (including functionally related buildings and buildings), expropriation to a natural person on the basis of a contract or a court decision on the approval of the auction act or on the basis of a court decision on the consolidation of real estate to the bidder, co-owner or creditor. It is also proposed to apply the relevant state tax in the amount of 1.5% of the value of real estate to land and construction property or construction property, the composition of which consists only of a non-residential building or non-residential buildings and engineering structures related to them, expropriation to a natural person on the basis of a contract or a court decision on auction approval of the act or on the basis of a court decision on the attachment of real estate to the bidder, co-owner or creditor. The relevant state fee in the amount of 2% of the property value of the apartment is supposed to be applied to the expropriation of the property of the apartment to a legal entity that conducts commercial activities, on the basis of a contract or a court decision on the approval of the auction act or on the basis of a court decision on the consolidation of real estate to the bidder, co-owner or creditor.
